General Terms and Conditions

Please read these General Terms and Conditions ("Terms") carefully before using the service.
1. Definitions
- Provider, we, us, our: Pixxta β Christian Adams, Germany
- Host: Any person who creates and manages an event
- Guest: Any person who takes part in an event via the event link or QR code
- Service: The website and all digital services offered through it (including the photo gallery, live wall, photo challenges, and messages)
- Content: Content uploaded or entered by hosts or guests (e.g. photos, messages, profile pictures)
- Merchant of Record: Paddle.com, which acts as an authorized reseller and payment processor
- Country: Federal Republic of Germany
2. Subject matter of the agreement
The service provides a platform through which hosts can collect their guests' photos and messages in one central place, display them on a live wall during the event, and make them available in a shared gallery afterwards.
Guests need neither an app nor their own account; participation is via an event-specific link or QR code.
3. Free and paid use
Registering, setting up, and testing an event is free. Reduced limits apply in test mode.
For unrestricted use, the event is activated with a one-time fee. Different packages are available that vary in scope β in particular, simply collecting photos after the event, or the full feature set including live wall, photo challenges, and messages.
The applicable prices and scope of services are shown on the website and during the activation process. The packages apply per event and for the maximum number of guests specified there.
4. Payment processing (Paddle)
Payment processing is handled exclusively by Paddle.com as merchant of record. This means:
- Paddle is the contracting party for payment processing
- Paddle issues invoices
- Paddle collects and remits any applicable taxes
The event is activated immediately after successful payment.
5. Right of withdrawal and refunds
For digital content and services, the statutory right of withdrawal under Section 356(5) of the German Civil Code (BGB) expires once performance has begun and the user has expressly agreed that performance may begin before the withdrawal period ends.
Since the event is activated immediately after payment, there is generally no entitlement to a refund.
This does not affect any goodwill refunds, in particular in the following cases:
- technical faults that make it impossible to use the service,
- demonstrable erroneous or duplicate charges.
Refunds are handled exclusively through the payment provider Paddle and in accordance with its policies.
6. User obligations
Hosts and guests agree to:
- only upload content they are authorized to use
- respect the personal rights of people shown in photos and obtain their consent
- not upload any unlawful, offensive, or content harmful to minors
- not use the service in an abusive manner
The host can moderate and remove content from their event. We reserve the right to delete unlawful content without prior notice.
7. Rights to content
The rights to uploaded photos and messages remain with their respective authors.
By uploading, the user grants the provider the simple right of use required to operate the service β to store the content within the respective event, process it technically (e.g. image sizes, crops), and display it to participants.
Technical processing includes an automated analysis of the image content. It aligns crops with detected faces and assigns terms to the photos, from which the gallery's sorting by moments, perspectives and themes is derived. No identification of depicted persons takes place, and the content is not used to train AI models. Details are governed by the privacy policy.
8. Storage and deletion
The content of an event is available for the duration of the event and the subsequent gallery period.
The host can delete their event at any time; doing so permanently removes all associated content, which then becomes unavailable.
9. Availability and warranty
The service is provided "as available."
There is no entitlement to:
- permanent availability
- Error-free operation
- a specific transmission speed, particularly in the case of a poor internet connection at the event venue
10. Limitation of liability
We are liable only for intent and gross negligence, as well as for injury to life, body, or health.
Liability for content uploaded by hosts or guests, as well as for indirect and consequential damages, is excluded to the extent permitted by law.
Liability is limited to the amount the host paid via Paddle for the respective event.
11. Intellectual property
All rights to the service, the software, and its structure and design remain with the provider.
12. Termination and suspension
The user can stop using the service and delete their account at any time.
We reserve the right to block or terminate access in the event of violations of these Terms.
13. Applicable law
The laws of the Federal Republic of Germany apply, excluding conflict-of-law rules.
14. Severability clause
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
15. Changes to these terms
We reserve the right to change these Terms.
